Australia’s legal system is based on principles that allow the courts to make fair rulings and decisions. These principles are important because they ensure that nobody is above the law and that everyone has a chance to prove their innocence.


High-quality evidence is an example of this in the case I am researching. In the case of Scott Austic, after being imprisoned for 12 years, evidence shows that majority of the critical pieces of evidence that put him in jail were planted.


Another principle of justice abused in this case was the presumption of innocence. Throughout this case, Scott was the prime and only suspect brought to the police’s attention, and he believed that he was guilty very early into the investigation.


An example of a principle of justice used correctly is the right to an appeal. This principle is fundamental in the Scott Austic case as he would still be locked away today. This appeal allowed Scott and his lawyers to bring up crucial evidence that allowed him to walk free after 12 years.


An investigation of the Scott Austic case will show that principles of justice can be misused by authorities, which can end in wrongful imprisonment. These principles also demonstrate that trials and investigations would not be fair with
